Mayweather no longer a defendant in false advertising suit

UPDATE: Floyd Mayweather and Rob Gronkowski are no longer defendants in this false-advertising lawsuit. The court's docket was unclear whether they agreed to a paid settlement or were voluntarily dismissed by the plaintiffs, but the case will continue against Snow Teeth Whitening LLC only.

ORIGINAL STORY FROM DECEMBER 2020: Boxing legend Floyd Mayweather Jr. has been sued for false advertising in a class-action lawsuit filed in federal court in Brooklyn, New York. The lawsuit alleges that Mayweather is not just a celebrity endorser but also a partner in the company Snow Teeth Whitening LLC. Also sued as an endorser / owner was NFL star Rob Gronkowski. The complaint accuses the defendants of engaging in a fraudulent scheme to deceive consumers into buying their teeth whitening products: "While Defendants unequivocally claim that their teeth whitening light delivers amazing results, independent lab testing proves that, in fact, their light does nothing to enhance their product’s purported ability to whiten teeth."

The lawsuit continued, "Defendants unjustifiably charge over a hundred dollars more than arguably comparable products based on their false claims that the lights they sell to consumers will dramatically improve the whitening power and antiviral or antiseptic qualities of Defendants’ accompanying products. In reality, Defendants’ lights are ineffective for those purposes and are very cheap lights that are similar to models sold online for less than five dollars."

Specific to Mayweather, the claims were that he has been compensated for contributing his name and image to promote the teeth-whitening products on social media and starred in an advertising video endorsing the product as “the best teeth whitening kit money can buy.” Mayweather is also accused of contributing sports memorabilia to increase sales of the products.
