Undefeated Canadian heavyweight Mladen Miljas is suing his promoter Greg Cohen and Greg Cohen Promotions. On Wednesday, a preliminary injunction hearing was calendared for April 9th to decide whether Miljas can seek fights outside the promotional agreement he signed with Cohen's company. Specifically, on April 9th, Miljas will be seeking a ruling that would prohibit Cohen from: contacting third parties with the intent to persuade them to terminate or cancel existing business relationships or contracts with Miljas; dissuading anyone from entering into business relationships or contracts with Miljas; and making false or defamatory statements about Miljas including making claims that Miljas remains subject to the promotional agreement he signed with Cohen. The dispute is being litigated in federal court in the Southern District of Iowa, which has scheduled a hearing to decie the motion on April 9th in Des Moines. Miljas is also suing for an award of monetary damages, but that will not be decided on April 9th
Cohen's defense is that he has offered the required number of fights to Miljas, but Miljas turned them down. On February 16th, the court held a hearing on the same issue, but the judge ordered Cohen to provide supporting documentation for his claim that Miljas was unreasonably rejecting the fight opportunities that Cohen presented. Cohen submitted his evidence and Miljas responded, but the court stated that Cohen's submssion did not resolve whether Miljas unreasonably declined fights. The court wrote, "Specifically, the affidavits submitted by Miljas and Cohen cannot be reconciled absent a credibility determination by the Court. This will be a live hearing and any testimony the parties wish to offer should be presented in-person."
